Shops & Establishments Act
The Shops and Establishments Act is in effect a labour licence adopted by governments that controls working conditions and outlines rights of employees in the unorganised sector by establishing a set of requirements for every business. Whether or not it employs staff, every store and institution must register under the Act within 30 days of starting operations.
Objectives:
With relation to working conditions, several laws and norms have been passed by each Indian state. The goal is to ensure equal benefits for employees working in a variety of enterprises, including retail stores, commercial buildings, residential hotels, restaurants, theatres, and other public entertainment venues.
This Act sets rules for:
- Working hours per day and per week,
- rules for distribution of work and rest periods,
- opening and closing times, days that businesses are closed,
- and national and religious holidays
- regulations for children, young people, and women working;
- rules for yearly, maternity, sick, and other leaves;
- rules for employment and termination of service;
- maintenance of registers and records;
- posting of notifications.
This statute is applicable to commercial establishments such as:
- A commercial or trading or banking or insurance institution, or
- An establishment or administrative service in which people are employed or primarily involved in office work, or
- A hotel, restaurant, boarding or dining house, a café or any other refreshment house, or
- A theatre, cinema, or any other public amusement or entertainment facility.
Documents Needed To Obtain A Telangana Labor License
- The store's or company's name.
- The business's complete address.
- The establishment's kind, such as store, restaurant, theatre, etc.; & the type of business, such as bakery, boutique, etc.
- The employer's or occupier's name.
- The occupier's or employer's ID, such as a passport, voter ID, or Aadhaar.
- The employer's or occupier's PAN card.
- A lease agreement or deed that shows the business's address, such as utility bills for power or telephone service.

Documentation & Details Needed For Compliance:
- The inspector will verify the application once it has been received, register the establishment in the register of establishments, and issue a registration certificate once he is satisfied that the application is genuine and complete. When the certificate expires, it must be reissued and conspicuously displayed at the establishment.
- Establishments are required to maintain current records of information pertaining to employees, penalties, advances, deductions, and fines, as well as compensation and vacation days. Depending on the state, the requirements could change. Each year, documents pertaining to annual holidays and the number of employees must be delivered to the Municipal Corporation office.
- Within 30 days of any changes to the partners' or directors' addresses or status, they must notify the department by submitting an online form.
- On or before the 31st of January of the following year, annual returns must be submitted electronically in Form U.
